Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the BulkUp mobile application for iOS and Apple Watch, the BulkUp website at getbulkup.com and the related services (together, the "Service"). The Service is provided by BulkUp ([Legal entity name and address]) ("BulkUp", "we", "us"). Please read these Terms carefully. Our Privacy Policy explains how we handle your personal data and forms part of these Terms.

1. Acceptance of these Terms

By creating an account, downloading or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of someone else, you confirm that you are allowed to accept these Terms on their behalf.

2. Eligibility and minimum age

You must be at least 16 years old to create an account and use the Service. By using the Service you confirm that you meet this age requirement. We may close any account we reasonably believe belongs to someone under 16.

3. Your account

• You can register with an email address and password, or with Sign in with Apple.
• You must give us accurate information and keep it up to date.
• You are responsible for keeping your login details confidential and for all activity that happens under your account. Tell us at support@getbulkup.com right away if you believe your account has been used without your permission.
• One person, one account. You may not share, sell or transfer your account.

4. The Service, and what it is not

BulkUp is a workout and diet tracking app. It lets you import or build training and diet plans, log sets, weights and reps, track workouts (including heart rate and energy data from Apple Watch), record body measurements, track meals and personal records, and share plans and progress with friends.

BulkUp is not medical advice. Any training or diet guidance shown in the Service, whether it comes from a plan you imported, from BulkUp's features or from an AI-generated result, is for general informational purposes only. It is not a substitute for advice from a doctor, dietitian, physiotherapist or certified coach. Consult a qualified professional before starting or changing any exercise or nutrition programme, especially if you have a medical condition, are pregnant, or have a history of injury. Stop exercising and seek medical help if you feel pain, dizziness or discomfort. You train at your own risk.

Calculated values such as estimated one-rep max (1RM), body composition and energy expenditure are estimates derived from formulas and sensor data. They can be inaccurate and should not be relied on for medical decisions.

5. Subscriptions and billing (BulkUp PRO)

Some features require a paid subscription called BulkUp PRO. BulkUp PRO is offered as an auto-renewable monthly or yearly subscription and is purchased exclusively through Apple's In-App Purchase system.

• Payment. Payment is charged to your Apple ID account when you confirm the purchase. Apple handles all payment processing; BulkUp never receives or stores your card details.
• Auto-renewal. Your subscription renews automatically for the same period and at the then-current price unless you cancel it at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within the 24 hours before the current period ends.
• Free trial. We may offer a free trial. If you do not cancel before the trial ends, the subscription starts and you are charged the subscription price. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Managing and cancelling. You can manage or cancel your subscription at any time in your App Store account settings (Settings → Apple ID → Subscriptions). Deleting the app or your BulkUp account does not cancel your subscription; you must cancel it separately in the App Store.
• Price changes. If we change the price of a subscription, Apple will notify you in advance and, where required, ask for your consent before the new price applies.
• Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. To request a refund, go to reportaproblem.apple.com. BulkUp cannot issue refunds for purchases made through the App Store.

6. Your content and the licence you give us

"User Content" means anything you upload or create in the Service: training and diet plans (including PDFs and photos of plans you import), logged workouts, measurements, meals, recipes, profile photo, notes and plan codes you share. You keep all rights you have in your User Content.

So that we can run the Service, you grant BulkUp a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, adapt and display your User Content, solely for the purpose of providing, maintaining and improving the Service for you and for the people you choose to share it with (for example, when you share a plan code or add a friend). This licence ends when you delete the content or your account, except for copies that remain in backups for a limited time, as described in the Privacy Policy.

You are responsible for your User Content. You confirm that you have the rights needed to upload it and that it does not infringe anyone else's rights. If you import a plan written by your coach or a third party, you confirm that you are entitled to use it for your own training.

7. Acceptable use

You agree not to:

• use the Service for anything unlawful, or in a way that breaches these Terms;
• upload content that is illegal, infringing, abusive, hateful or that contains malware;
• harass other users, or use friend codes or shared plans to contact people who have not agreed to it;
• try to access other users' accounts or data, or probe, scan or test the vulnerability of our systems;
• reverse engineer, decompile or scrape the app or the API, or use automated tools to access the Service beyond the normal use of the app;
• resell, sublicense or commercially exploit the Service or its content without our written permission;
• circumvent subscription or purchase mechanisms.

8. AI features

The Service uses artificial intelligence to read the PDF or photo of a plan you upload and turn it into a structured programme, and to generate recipes on request. To do this, the file or text you submit is sent to third-party AI providers (currently Anthropic and OpenAI) for processing, as described in the Privacy Policy.

AI output can be wrong. Imported plans may contain mistakes (wrong exercise, sets, reps, weights or meals) and generated recipes may be inaccurate, including about ingredients, quantities, calories or allergens. Always review AI-generated results before relying on them. You can edit any imported plan in the app. BulkUp is not responsible for decisions you make based on AI-generated content.

9. Intellectual property

The Service, including the app, the website, the BulkUp name and logo, the exercise database, designs, text, graphics and software, is owned by BulkUp or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple devices you own or control, as permitted by the App Store terms. Nothing in these Terms transfers any ownership to you.

If you send us feedback or suggestions, you agree that we may use them without any obligation to you.

10. Termination and account deletion

You can delete your account at any time in the app (Profile → Delete account). Deleting your account permanently removes all data stored on our servers for that account, as described in the Privacy Policy. Remember to cancel any active subscription in your App Store settings first; account deletion does not cancel it.

We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if we discontinue the Service. Where reasonably possible we will give you notice first. Sections that by their nature should survive termination (including 6, 9, 11 and 13) will survive.

11. Disclaimers and limitation of liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, BulkUp makes no warranties, express or implied, about the Service, including that it will be uninterrupted, error-free or that data will never be lost. We recommend that you keep your own copy of important plans and records.

To the fullest extent permitted by law, BulkUp will not be liable for any indirect, incidental, special or consequential damages, loss of data, loss of profits, or personal injury arising from your training or nutrition choices, and our total liability for all claims relating to the Service in any 12-month period will not exceed the amount you paid us for the Service in that period (or 50 EUR if you paid nothing).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under consumer protection law in Spain and the European Union. If you are a consumer, you keep all the mandatory rights granted to you by the law of your country of residence.

12. Changes to the Service and to these Terms

We may change, add or remove features of the Service from time to time. We may also update these Terms. If a change is material, we will notify you in the app or by email at least 15 days before it takes effect, unless the change is required by law or concerns a new feature. By continuing to use the Service after the change takes effect, you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

13. Governing law and disputes

These Terms are governed by the laws of Spain. Any dispute arising from these Terms or the Service will be submitted to the courts of the user's place of residence when the user is a consumer resident in Spain or the European Union, and otherwise to the courts of Spain. Consumers in the EU may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

14. Apple-specific terms

The app is distributed through the Apple App Store. These Terms are between you and BulkUp only, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the App Store Terms of Service.
